Dock Permits in South Florida: FDEP Exemption, Setbacks and County Reviews

Almost every dock in Florida needs some approval, but many single-family docks qualify for a state exemption you can self-certify online instead of a full permit. This guide covers that exemption, the federal layer, riparian setbacks, and what Miami-Dade, Broward, Palm Beach and Manatee counties add. For the permit authorities by county, see our county-by-county permit guide.

The Florida DEP dock exemption: 1,000 square feet, or 500 in Outstanding Florida Waters

Florida Statute 403.813(1)(b) exempts a private recreational dock from the state environmental resource permit when its over-water area is 1,000 square feet or less, or 500 square feet or less in Outstanding Florida Waters. The dock must sit on pilings or float, involve no dredging or filling beyond setting the pilings, must not impede flow or navigation, and must be the only exempt dock along 65 feet of shoreline. [flsenate.gov]

The same exemption is written into F.A.C. 62-330.051(5)(b). Docks in artificially created waterways such as residential canals fall under paragraph (5)(c), also at 1,000 square feet. [law.cornell.edu]

You do not have to wait for a letter. FDEP's online self-certification covers a new single-family dock with or without a boat lift, repair or replacement of an existing dock, and adding a lift to an existing dock. There is no fee. [floridadep.gov]

A dock that does not fit the exemption often still fits a general permit. F.A.C. 62-330.427 covers a private, single-family dock or pier with up to two boat lifts where the total over-water area of every structure on the shoreline combined stays at or under 2,000 square feet, moors no more than two vessels, and is the only dock on that parcel. Bigger docks and sensitive sites need an individual permit. [law.cornell.edu]

Because the bottom is usually state-owned sovereign submerged land, a letter of consent for its use comes with the state authorization. [floridadep.gov]

Installing or repairing pilings on a private dock is its own exempt activity under 62-330.051(5)(a), so a piling job does not reopen the dock's authorization. [law.cornell.edu]

Boat lifts have their own limit inside the exemption: up to 500 square feet, or 200 square feet in Outstanding Florida Waters. [flsenate.gov]

The state exemption never replaces the local building permit, and three of the four counties we serve add an environmental review of their own.

Riparian rights, the 25-foot setback and how far a dock can extend into a canal

Riparian rights come with land that reaches the ordinary high-water line of navigable water. They include access, boating and the right to a dock, but not ownership of the bottom. [flsenate.gov]

Under F.A.C. 18-21.004, a dock or mooring piling on sovereign submerged land must sit at least 25 feet inside your riparian lines. A marginal dock along the seawall may be within 10 feet. Parcels under 65 feet wide, or owners holding a neighbor's written consent, can qualify for an exception. The same rule caps a dock at 25 percent of the width of the waterbody. [law.cornell.edu]

FDEP publishes a setback-waiver letter of concurrence for the neighbor's consent. [floridadep.gov]

Cities tighten these numbers with their own projection caps and side setbacks; the dock-construction page for each city under our locations carries the local rule. And a neighbor cannot legally build in front of your property: their dock must stay inside their riparian lines and 25 feet off the shared line unless you sign the waiver.

The Army Corps layer

The U.S. Army Corps of Engineers Jacksonville District reissued Regional General Permit SAJ-20, effective March 28, 2023, covering docks and boat lifts statewide. [saj.usace.army.mil]

For most single-family docks the federal side is a general permit coordinated with the state review (the state programmatic general permit, or SPGP) rather than a separate application. Ask your contractor which federal authorization your dock is using.

What Miami-Dade, Broward and Palm Beach add

Miami-Dade DERM Class I permit. The county's Division of Environmental Resources Management requires a Class I Coastal Construction Permit before any work in, on, over or upon tidal waters or coastal wetlands anywhere in the county, including inside cities, docks, pilings and lifts included. [miamidade.gov]

Miami-Dade's Manatee Protection Plan dates from 1995 and is being revised; FWC and the regulatory agencies apply these plans to new or expanding boat facilities. [myfwc.com]

Expect a seagrass survey request at many Miami-Dade sites. FDEP's benthic survey growing season runs April 1 through September 30. [ecfflorida.com]

Much of Biscayne Bay is a state aquatic preserve, where the 500-square-foot limit applies along with preserve design rules: one dock per residence, two boats at most, a terminal platform of no more than 160 square feet and a 4-foot walkway. [breezypermits.com]

Broward County: general license or ERL. Broward's Environmental Protection and Growth Management Department issues an Environmental Resource General License for low-impact work: repairing or replacing a dock not enlarged beyond 500 square feet of over-water area with no waterward fill, and installing a boat lift. Larger or new work needs a full Environmental Resource License. [broward.elaws.us]

Palm Beach County: Type 8 building permit. The county files docks, lifts and boathouses as Type 8 Marine Structures, and the application asks you to attest that every Authority Having Jurisdiction over the water has approved the work. [discover.pbcgov.org]

Palm Beach County's own Manatee Protection Plan dates from 2007. [myfwc.com]

The Loxahatchee River is both an Outstanding Florida Water and an aquatic preserve, so the 500-square-foot limit and preserve rules apply there. [courtlistener.com]

Manatee County: a Waterfront Structure permit and Outstanding Florida Waters

Manatee County's Building Division lists Waterfront Structure among its standard permits. The application needs building plans plus a site plan or survey and goes through the county's Accela portal; the permitting section is reached at 941-748-4501, extension 3800. [mymanatee.org]

Water classification matters more here. Anna Maria Sound, Perico Bay and Palma Sola Bay carry Outstanding Florida Waters designations, and aquatic-preserve rules call for 1 foot of clearance over seagrass. [sarasotalaw.org]

In those waters the state exemption drops from 1,000 to 500 square feet. [flsenate.gov]

Manatee County does not appear on FWC's list of counties with an approved Manatee Protection Plan. [myfwc.com]

We did not find a county environmental dock review in Manatee comparable to DERM or Broward's EPGMD, and cities such as Bradenton add dock rules of their own. Confirm the current process with the Building Division before you design.

What to prepare, and how long a dock permit takes

  • A current survey showing the riparian lines, and a plan view with the over-water square footage, since that number decides the exemption tier.
  • Photos of the existing dock and seawall, any prior permits or self-certifications, and the boat and lift capacity you intend.
  • Timelines we can source: Broward's code says the general license is issued within ten days of application. [broward.elaws.us]
  • One Broward permit consultant estimates three to four months end to end for a new dock. That is its estimate. [breezypermits.com]
  • A Miami-Dade real estate firm's guide describes roughly 10 days for qualifying low-impact work on an expedited path and several months for a new dock. Again, its estimate, not ours. [gabrielmoyers.com]

Questions we hear about this

Do I need a permit for a boat lift, or to add one to an existing dock?

A local building permit, yes. On the state side, a lift on a private dock fits the exemption up to 500 square feet, or 200 in Outstanding Florida Waters, and FDEP's self-certification covers adding a lift to an existing dock. Broward's general license covers lift installation; Miami-Dade requires a Class I permit for any work over tidal water. [source]

Do I need a permit to replace dock pilings?

Installing or repairing pilings on a private dock is exempt from the state environmental resource permit under F.A.C. 62-330.051(5)(a). You still need the local building permit, and in Miami-Dade a Class I permit, because the work happens over tidal water. [source]

Do I need a seagrass survey for a dock permit?

Often in Miami-Dade, and anywhere seagrass or hardbottom is likely. The survey documents what lives under the proposed dock so the reviewer can check clearance. FDEP's benthic survey growing season is April 1 through September 30, so a winter application may wait for spring. [source]

How far can my dock extend into a canal in Florida?

The state rule for sovereign submerged land caps a dock at 25 percent of the width of the waterbody and keeps it 25 feet inside your riparian lines. Cities set tighter projection and side-setback limits, and the stricter rule controls. Check the dock-construction page for your city. [source]

The home I am buying has a dock with no permit history. What should I do?

Ask the seller for building permits and any FDEP self-certification. FDEP's post-storm guidance stresses documenting what legally existed, because the repair-and-replace exemption covers an authorized structure, not an expansion. Add a pre-purchase inspection of the pilings below the waterline and the lift rating against your boat. [source]
